Your Digital Guide for Consumer Rights Protection in Mexico
Updated information on fraud identification, procedures for improper charges, and guidance on reporting to PROFECO. An educational resource to empower Mexican consumers.
Know your rights protected by Mexican legislation
Consumers have the right to receive clear, truthful, and sufficient information about the products and services they acquire. This information must include characteristics, quality, price, warranties, sales conditions, and all relevant data to make an informed decision.
The law protects consumers against unauthorized charges, duplicate billing, or uncontracted services. If you detect an improper charge, you have the right to request its cancellation and immediate refund, as well as to file a formal complaint with competent authorities.
Every product or service must meet quality standards and have appropriate warranties. Consumers can demand repairs, replacements, or returns when goods do not meet promised specifications or have manufacturing defects.
Consumers have the right to receive fair, equitable, and respectful treatment from providers. Any form of discrimination based on gender, age, ethnic origin, social or economic status, or any other circumstance is prohibited.
Learn to recognize warning signs and protect yourself effectively
Legitimate institutions never request confidential information by phone. Be wary of calls demanding urgent payments, threats, or pressure to provide banking information. Always verify the caller's identity before sharing personal information.
Phishing emails imitate legitimate organizations to steal information. Carefully examine email addresses, suspicious links, and spelling errors. Never click on links from unknown senders or those requesting urgent account verification.
Verify the authenticity of websites before making purchases. Look for security certificates, reviews from other users, and secure payment methods. Be wary of overly attractive offers, unrealistically low prices, or sites without clear contact information.
Protect your credit and debit cards by using them only in trustworthy establishments. Cover the keypad when entering your PIN, regularly review your account statements, and immediately report any unrecognized transactions. Activate purchase alerts in your banking app.
Carefully read the terms and conditions of any promotion. Verify the organizer's legitimacy, be wary of unsolicited prizes, and never pay to claim a supposed prize. Legitimate promotions do not require prior deposits or detailed banking information.
Protect your personal documents and avoid sharing confidential information on social networks. Use strong and unique passwords for each service, activate two-factor authentication, and regularly monitor your credit history to detect unusual activities.
Procedures for filing complaints and defending your rights
The Federal Consumer Protection Agency is the government organization responsible for protecting consumer rights in Mexico. Its mission includes promoting a culture of intelligent consumption, monitoring compliance with legal provisions, and resolving conflicts between consumers and providers.
PROFECO offers free advisory, conciliation, and arbitration services to resolve commercial disputes
Before filing a complaint, collect all related evidence: proof of purchase, contracts, warranties, product photographs, conversation screenshots, bank statements, and any correspondence with the provider. Complete documentation accelerates the process.
You can file your complaint online through the PROFECO portal, by phone at 5568 8722 in Mexico City or 800 468 8722 from other locations, or in person at any delegation. The process is free and does not require a lawyer. Provide detailed and clear information about the problem.
PROFECO will summon both parties to a conciliation hearing. During this stage, a conciliator will facilitate dialogue to reach a satisfactory agreement. Most cases are resolved in this phase. It is important to attend punctually and maintain a constructive attitude.
If conciliation does not succeed, you can opt for arbitration, where an arbitrator will issue a binding resolution, or continue with other legal avenues. PROFECO can also conduct verification visits to the establishment and apply sanctions if irregularities affecting multiple consumers are detected.
